1. Introduction

Welcome to CFP Prints.

These Terms & Conditions govern your use of this website and the purchase of fine art prints, photographic artworks and related products offered by CFP Prints.

By accessing this website, placing an order or otherwise using our services, you agree to be bound by these Terms & Conditions together with our Privacy Policy and any other policies referenced on this website.

If you do not agree with these Terms, please do not use this website.

2. About CFP Prints

CFP Prints is the fine art publishing division of Craig Fouché Photography, specialising in museum-quality photographic artworks for private collectors, galleries, institutions and commercial spaces.

Our collections include open edition and limited edition fine art prints produced using carefully selected archival materials and professional printing techniques.

3. Ordering Artwork

Placing an order constitutes an offer to purchase the selected artwork.

Orders become accepted once payment has been successfully received and we have commenced production or confirmed dispatch.

Should an order be unavailable, contain an obvious pricing error or be incapable of fulfilment, we will contact you as soon as reasonably possible to discuss an appropriate solution, including a refund where applicable.

4. Artwork Production

Many artworks are individually produced to order.

Production includes professional printing, inspection, signing where applicable, embossing, edition verification and final quality control before dispatch.

Estimated production times published on this website are provided in good faith and may vary according to workload, supplier availability or other reasonable production requirements.

5. Limited Editions

Where an artwork is offered as a Limited Edition, no more than twenty-five (25) prints of that artwork will be produced worldwide unless expressly stated otherwise.

Each Limited Edition print is individually signed, numbered and accompanied by a Certificate of Authenticity.

Once an edition has sold out, no further prints of that edition will be produced.

6. Certificates of Authenticity

Each artwork supplied with a Certificate of Authenticity includes documentation identifying the artwork, edition (where applicable), artist and production details.

Collectors are encouraged to retain the Certificate of Authenticity permanently with the artwork, particularly for insurance, exhibition, resale and archival purposes.

7. Artwork Presentation

Product photographs are intended to represent each artwork as accurately as reasonably possible.

Variations in monitor calibration, mobile displays and printing technologies mean that slight differences in colour, brightness or contrast may occur.

Such variations do not constitute defects.

8. Sizes, Borders and Framing

Artwork sizes, borders and available presentation options are described on the relevant product pages.

Unless otherwise stated, prints include an archival handling border suitable for professional mounting and framing.

Framing, where offered, is supplied as a bespoke service.

9. Pricing and Payment

Unless otherwise stated, all prices are displayed in United States Dollars (USD).

Accepted payment methods are displayed during checkout.

Orders proceed once payment has been successfully authorised and received.

Applicable taxes, shipping costs and other charges are presented before payment is completed.

10. Shipping and Delivery

Shipping is provided in accordance with our Shipping Policy.

Estimated dispatch and delivery times are provided for guidance and cannot be guaranteed.

International customers remain responsible for any import duties, customs charges, VAT or local taxes applicable within their destination country unless expressly stated otherwise.

11. Ownership and Risk

Ownership of physical artwork transfers to the purchaser once full payment has been received.

Risk of loss or damage transfers upon confirmed delivery by the courier.

Should artwork arrive damaged, customers should follow the procedures described in our Damage and Returns Policy.

12. Returns

Returns are governed by our Returns Policy.

Because many artworks are individually produced to order, returns may not always be possible except where required by applicable consumer legislation or where an artwork is damaged or defective.

13. Copyright

The purchase of a print transfers ownership of the physical artwork only.

No copyright, reproduction rights or commercial usage rights are transferred unless expressly agreed in writing.

Artwork may not be reproduced, scanned, copied, published, licensed or commercially exploited without prior written permission.

14. Intellectual Property

All photographs, artwork, text, branding, logos, website design and other creative content appearing on this website remain protected by copyright and other intellectual property laws.

Unauthorised reproduction or commercial use is prohibited.

15. Website Use

You agree to use this website lawfully and responsibly.

You must not:

interfere with website security or operation;
introduce malicious software;
attempt unauthorised access;
scrape or harvest website content;
reproduce website material without permission.

16. Privacy

Personal information is processed in accordance with our Privacy Policy.

By placing an order or submitting information through this website, you acknowledge that your information will be handled in accordance with that policy.

17. Limitation of Liability

CFP Prints takes great care in producing, inspecting and packaging every artwork.

To the fullest extent permitted by law, CFP Prints shall not be liable for indirect or consequential losses arising from delays, courier interruptions or circumstances beyond our reasonable control.

Nothing in these Terms limits any rights available under applicable consumer legislation.

18. Force Majeure

We shall not be responsible for delays or failure to perform arising from circumstances beyond our reasonable control, including natural disasters, severe weather, transport disruption, industrial action, power failures, internet outages, supplier delays, government restrictions or other unforeseen events.

Where practical, customers will be kept informed of significant delays.

19. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.

20. Changes to these Terms

We may update these Terms & Conditions from time to time to reflect changes in our business, products or legal obligations.

The latest version will always be available on this website.
